THIS SUMMONS IS DIRECTED TO: DEFENDANTS ABOVE NAMED.
YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is on file in the office of the court administrator of the above named court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no Court file number on this summons.
YOU MUST REPLY WITHIN 21 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 21 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this summons located at: 102 Second Avenue Northwest, Roseau, MN 56751.
YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. IF you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.
YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the complaint, you do not need to respond. A default can then be entered against you for the relief requested in the complaint.
LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.
ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 or the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.
THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Lake of the Woods County, State of Minnesota, legally described as follows:
EXHIBIT "A"
That part of Government Lot 4, Section 16, Township 162 North, Range 32 West, Lake of the Woods County, Minnesota, lying easterly of the easterly line of the tract described as follows: Beginning at a point on the quarter line, 187.62 feet East of the quarter comer between Sections 16 & 17, Township 162 North, Range 32 West of the Fifth Principal Meridian; thence North, on a line parallel with the Section line between said Sections 16 & 17~ a distance of 313.03 feet to a point; thence South 72° 20' East, a distance of 65.475 feet to a point; thence South, on a line parallel with the Section line between said Sections 16 & 17, a distance of 290.375 feet to a point on the East and West quarter line; thence West, along said quarter line, a distance of 62.38 feet to the point of beginning; said described tract of land being in Lot 4, Section 16, Township 162 North, Range 32 West, TOGETHER with that portion of said Lot 4, Section 16, lying between the North line of the tract above described, and the meandered shore line of Lake of the Woods; bounded on the West and East by the West and East lines, respectively, of the tract above described when extended to the meandered shore line of said Lake of the Woods.
AND
That part of Government Lot 5, said Section 16 lying northerly of the following described line; Commencing at the southwest corner of said Section 16; thence northerly 2230.00 feet along the west line of said Section 16 to the point of beginning of the line to be described; thence easterly and perpendicular with said west line of Section 16 to the shore of Four Mile Bay on Lake of the Woods and said line there terminating; EXCEPT the West 250.00 feet of said Government Lot 5.
The object of the action is to determine title and adverse claims and to extinguish and exclude the Defendants from any such interest or lien therein as more fully set forth in the Complaint filed of record with the Court Administrator in the above named District Court.
