AN ORDINANCE AMENDING TITLE XIII OF THE BAUDETTE CITY CODE TO PROHIBIT THE USE OF CANNABIS AND HEMP PRODUCTS IN PARK FACILITIES

THE CITY COUNCIL OF THE CITY OF BAUDETTE, MINNESOTA DOES HEREBY ORDAIN:

SECTION 1. Title XIII of the Baudette City Code, entitled General Offenses, is hereby amended by adding a new section 130.07 as follows:

§ 130.07 CANNABIS AND HEMP

(A) No person shall use cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in a public park facility. A violation of this section shall be considered a petty misdemeanor notwithstanding any other penalty provision in the city code.

(B) For purposes of this section, the term “public park facility” shall include any of the following locations or facilities that are made available to the general public: parks, golf courses, playgrounds, beaches, swimming pools, trails, nature areas, recreation centers, or any other facility designated by the city for park and recreation use. Pursuant to Minnesota Statutes, section 152.0263, subd. 5, the term “public park facility” shall not include the premises of an establishment or event licensed to permit on-site consumption of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products.

(C) For purposes of this section, the terms “cannabis flower,” “cannabis products,” “lower-potency hemp edibles,” and “hemp-derived consumer products” shall have the definitions given to them in Minnesota Statutes, section 342.01, as it may be amended from time to time.

SECTION 2. This ordinance shall take effect following its adoption and publication in accordance with law.
