A RESOLUTION AUTHORIZING SUMMARY

PUBLICATION OF ORDINANCE 170.11.122

WHEREAS, the City Council of the City of Baudette has adopted Ordinance 170.11.122, titled “AN INTERIM ORDINANCE AUTHORIZING A STUDY AND IMPOSING A MORATORIUM ON THE OPERATION OF CANNABIS BUSINESSES WITHIN THE CITY OF BAUDETTE”; and

WHEREAS, in the case of lengthy ordinances or those containing charts or maps, Minnesota state law allows the City Council to approve, by a four-fifths vote, the publication of an ordinance by title and summary only; and

WHEREAS, the expense to publish the complete three-page text of Ordinance 170.11.122 is not justified; and

WHEREAS, the following summary clearly informs the public of the intent and effect of the ordinance.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Baudette, Lake of the Woods County, Minnesota, that the following summary is hereby approved for publication:

SUMMARY PUBLICATION

ORDINANCE NO. 170.11.122

The City Council of the City of Baudette has adopted Ordinance 170.11.122, titled “AN INTERIM ORDINANCE AUTHORIZING A STUDY AND IMPOSING A MORATORIUM ON THE OPERATION OF CANNABIS BUSINESSES WITHIN THE CITY OF BAUDETTE.” The ordinance prohibits the operation of any cannabis business, as that term is defined in Minnesota Statutes, section 342.01, subd. 14, while the city undertakes a study regarding such businesses. While the ordinance is in effect, no business, person, or entity may operate a cannabis business within the jurisdictional boundaries of the city, and the city will not accept, process, or act on any application, site plan, building permit, or zoning or other approval for a business proposing to engage in the operation of a cannabis business in the city. The full text of Ordinance No. 170.11.122 is available for inspection at Baudette City Hall during regular business hours.

NOW, THEREFORE, BE IT FURTHER RESOLVED, by the City Council of the City of Baudette, Lake of the Woods County, Minnesota, that the City Clerk keep a copy of Ordinance 170.11.122 at City Hall for public inspection during business hours and post a full copy of the ordinance in a public place in the City.

Adopted and approved by the City Council of the City of Baudette on a vote of 5 ayes and 0 nays effective on the 10th day of July 2023.
